
NORMATIVE ACT FOR THE ATTRIBUITION OF DOMAINS NAMES IN BRAZIL
1. REGISTRATION
The Brazilian Internet Steering Committee (CG) is the organisation responsible for the registration of Internet Domain Names in Brazil. It follows the rules below:
I. A Domain Name is usually given to its first solicitant. However, this concession can be canceled by the Steering Committee in the terms determined in item 5.
II. The Steering Committee doesn't take the responsibility for the choice of a Domain Name, as well as for any current damages caused by its improper use.
III. The solicitant must use the requested Domain Name regularly, as mentioned on the Domain Name Registration Form.
IV. Only legal organisations are allowed to register domain names in Brazil. The organisation must be registered at the 'Cadastro Geral de Contribuintes' (Ministry of Finance Taxpayers' Record) and possess a CGC number.
V. Each organisation is allowed to solicit only one Domain Name, except for expressed authorization given by the Steering Committee.*
VI. The Steering Committee is responsible for the maintenance of Domain Names in the following categories: for government organisations ( .gov.br), non governmental (.org.br), commercial (.com.br), military (.mil.br), educational (.edu.br ) and telecommunication companies (.net.br), or any other sub-domain further created by the Committee under the Brazilian Internet.**
VII. The Steering Committee is not responsible for the management of new divisions and sub-domains created by the solicitant under the registered Domain Name. This is also apllied to all the categories related in the item 1.VI.
* The Steering Committee decided, in June 18th, 1997 to give each organisation the right to apply for up to 10 (ten) domain names per CGC.
** The new TLDs (.art, .esp, .ind, .inf, .psi, .rec, .tmp, .etc) were available for registration in December of 1997.
2. REGISTRATION AND MAINTENANCE SERVICE
I.In the case of a registration, when it is a new request for a Domain Name, a fee wil be properly defined by the Steering Committee and,***
II.Regarding the maintenance of a Domain Name, for each 12 month period a new fee must be paid (it will be defined by the Committee). The payment must be made in advance by the solicitant and in case of a new request, a registration fee will be charged.
*** The fees (R$ 50,00 for registration and R$ 50,00 maintenance) started being charged in January of 1998.
3. RESPONSIBILITIES OF THE SOLICITANT
The solicitant is under the obligation of answering for any lawsuits or extra-judicial oders which may result from the violation of rights or damages caused by the misuse of a Domain Name. The Steering Committee can not be hold responsible for damages cause by harmful conducts.
4. MODIFICATIONS
The Steering Committee can periodically modify the terms of the present Normative Act, but it must make it public at www.cg.org.br 30 days before the change takes place. The Committee can also change the value of the registration and maintenance fees provided it takes into account the solicitant?s acquired rights.
5. THE CANCELLATION
the right of use to a registered domain name under the domain .br can be extinguished:
I. by expressed renoucement of the respective owner (proper documentation required);
II. by expiration of the 12 (twelve) months period of protection, starting from the date of concession of the domain name, in the terms proposed by the Steering Committee. In case there is no renewal, the registration will be canceled within 30 (thirty) days;
III. by means of irregular use of the domain name in the continuous period of 180 (one hundred eighty) days;
IV. by judicial order;
V. by disobedience, notified in writing, of the rules established by the Steering Committee, during the period of 30 (thirty) days, or less, in case of judicial decision;
VI. In the hypotheses above mentioned, no indemnity or warranty is given to the petitioner after the cancellation of the domain
name.
